The website www.pakdeals.com is operated and owned by M/s Deals 4 U (Private) Limited, with its registered office at 132 D, 3rd Floor, Dr. Hamid Hussain Farooq Road, Block 2, PECHS, Karachi, herein-after referred to as ("Pakdeals", “Pakdeals website”, ‘Platform”, "we", "us", "our"). As the user ("user", "you", "your"), you agree to read and accept each clause, term, and condition of this User Agreement in its entirety. By sign-up and registering as Member on our website you will be legally deemed to have accepted the entire terms and conditions in view of Section 7 and Section 8 of the Contract Act, 1872 and this Agreement shall accordingly be a valid contract under Section 10 of the Contract Act, 1872. Violation of any clause, terms, and condition shall lead to disentitlement of any interest available to you on Pakdeals website. Membership and/or usage of the Platform are restricted to individuals who are at least 18 years old or meet the legal age requirement under applicable laws to enter into a contract, if different. Furthermore, you assert that all information provided during registration or submission to us is accurate and truthful. The Platform is inaccessible to users whose Membership has been denied, restricted, suspended, or revoked by us. Additionally, no user is permitted to register as a member on the Platform more than once.

To access the Services and utilize the Platform, you must create an account and register your information with us to establish a Membership ("Membership"). You acknowledge that all information provided to us will be accurate and complete, and you agree not to register or attempt to enter the Membership under another person'sname. Additionally, you agree not to select a username that we, in our sole discretion, deem offensive. We retain the right to refuse Membership, or to limit, suspend, or withdraw access to the Platform for any individual, at any time, and for any reason.

You are responsible for ensuring that Membership details are kept up-to-date, accurate, and complete at all times. If any information provided is found to be untrue, inaccurate, not current, or incomplete, or if we suspect such inaccuracies, we reserve the right to indefinitely suspend, limit, or withdraw your Membership and/or access to the Platform.

During the registration of your Platform account to create your Membership, you will need to provide specific information and set a username and password. It is your responsibility to maintain the security of your Platform account by taking reasonable precautions, and you must ensure the confidentiality of your account and password is upheld at all times.

You agree to assume liability for all activities conducted under your Platform account. If someone other than yourself uses the Platform with your login credentials, you will be held responsible for all actions taken under your name.

You are prohibited from using another person's Membership at any time. You agree to fully reimburse Pakdeals for any costs, expenses, or damages resulting from improper, unauthorized, or illegal use of your Membership and password by you or any party accessing the Platform through your account.

You may not transfer or sell your Membership or account details to another party, and you acknowledge that you are solely responsible for all activity conducted on the Platform using your Membership.

You are not permitted to access or utilize the Platform or Services for any purpose other than their intended use. Moreover, you must refrain from employing the Platform or Services in a manner that infringes upon the rights of others or disrupts their enjoyment of the Platform

Specifically, when using the Platform or Services, you must avoid:

Copying, modifying, distributing, selling, or leasing any portion of the Platform is strictly prohibited. Without lawful restriction or our written authorization, you must not attempt to reverse engineer or extract the source code of the Platform. Access to the Platform must solely occur through the interfaces provided by us (e.g., no automated scraping of the Platform or framing of its content), and you must not disrupt the Platform's operations.

Unauthorized access to any part of the Platform, its associated systems or networks, or Services offered through it, through hacking or other illegitimate means, is strictly forbidden.

Furthermore, you agree not to take any actions that unduly burden thePlatform's infrastructure, our systems or networks, or those connected to the Platform or us. Additionally, you must refrain from using any device or software to interfere with the proper functioning of the Platform or transactions conducted on it, or with other user's use of the Platform.

If you initiate a payment for any of our Services through our Platform, the information you provide will be securely transmitted to our payment provider. Prior to finalizing the transaction, please ensure that you have reviewed the relevant terms and conditions provided by your bank.

Please note that conducting multiple transactions on our Platform may result in multiple entries on your monthly credit or debit card statement.

The prices listed for products on our Platform include taxes and will be billed in PKR (Pakistani Rupee). Should you make a payment from abroad, slight variations in values may occur due to fluctuations in foreign exchange rates. We do not accept liability nor offer compensation for any losses incurred as a result of these rate changes. Pakdeals makes no assurances or representations concerning the exchange rates provided for any transaction and is not obliged to provide the most competitive rates available.

In the event of any defective products purchased from Pakdeals, we will provide a remedy as per applicable laws subject to examination of your complaint and product in question. You acknowledge and agree that any refund requests may impact your eligibility to participate in Promotions and your chances of winning Prizes (as detailed further in the Promotion Terms). This is because your participation in Promotions is directly tied to your purchase of products and Services offered on the Platform.

The personal data you furnish while utilizing the Platform will be handled in adherence to our Privacy Policy, which is hereby integrated into and constitutes an integral component of the Terms.

In order to meet our commitments to you as outlined in these Terms, we may need to correspond with you via email, other electronic messaging methods, and/or by posting notifications on the Platform. The Platform and its content, which encompass text, software, graphics, photos, music, videos, and interactive features("Materials"), alongside trademarks, service marks, and logos("Marks"), are either the property of Pakdeals or are licensed to Pakdeals, and are protected by copyright and other intellectual property laws under the IPO Laws of Pakistan.

Some content visible on the Platform may belong to third parties and could be subject to licenses granted by these third parties to Pakdeals. You are strictly prohibited from engaging in reverse engineering, decompiling, or disassembling such content. This agreement does not grant you any rights concerning such content. The Materials on the Platform are provided to you "as is" for informational and personal use only. You are not authorized to use, copy, reproduce, distribute, transmit, broadcast, display, sell, license, or exploit the Materials for any other purposes without obtaining prior written consent from the respective owners.

Pakdeals reserves all rights not explicitly granted herein to the Platform and the Materials. You agree not to engage in the use, copying, or distribution of any Materials beyond what is expressly permitted herein. This includes refraining from using Materials belonging to third parties obtained through the Platform for commercial purposes. You are also forbidden from bypassing, disabling, or otherwise interfering with security features or limitations on the use of the Platform or its Materials.

Content provided through the Services is safeguarded by copyright as a collective work and/or compilation, in accordance with copyright laws, other statutes, and international treaties. Any reproduction, modification, or creation of derivative works from the Platform, Materials, or collective work or compilation is expressly prohibited. Copying or reproducing any portion of the Platform or Materials for further reproduction or redistribution is also expressly prohibited.

You acknowledge that you will encounter Materials from various sources, and to the extent permitted by applicable law, Pakdeals disclaims responsibility for the accuracy, usefulness, safety, or intellectual property rights of such Materials. You agree to assume all liability for your use of any such Materials.

The products and goods featured on our platform belong to third-party owners and are displayed with their explicit permission. Pakdeals bears no responsibility for any harm or loss suffered by third parties due to the use or application of information provided for the products or services on our website. While we endeavor to ensure the accuracy and timeliness of this data in collaboration with our partners, we cannot guarantee its reliability at all times.

Upon termination, your access to the Platform or your Membership will cease, and we retain the right to enforce this termination using any available means. You agree to promptly inform Pakdeals of any unauthorized use of your Membership or any other security breach.

Termination or restriction of your access or usage will not waive or affect any other rights or remedies to which we may be entitled by law.

In no event shall we be liable for any delay, failure, or interruption of the Services provided via the Platform or any disruption to the Platform itself, arising directly or indirectly from circumstances beyond our reasonable control. Such circumstances may include, but are not limited to, acts of nature, forces, or causes beyond our control, such as:

Severability: Should any provision within these Terms be deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, and its removal does not alter the fundamental nature of these Terms, said provision shall be severed, while the remaining provisions shall continue in full force and effect.

No Waiver: Our failure to enforce any terms as outlined in these Terms or other associated policies does not relinquish our rights to enforce said terms.

Assignment and third-party rights: You are prohibited from transferring or subcontracting any of your rights or obligations under these Terms to any third party without our prior written consent. We reserve the right to assign, transfer, or subcontract any of our rights or obligations under these Terms to any third party at our discretion, without requiring your consent or providing notice.

The Terms will be governed by the laws of Pakistan, and any disputes will be referred to an arbitrator appointed in accordance with legal procedures.

In addition to your acceptance of the Terms, the following conditions govern your participation in our promotions ("Promotions") and your eligibility to win prizes ("Prizes").

We reserve the right to modify these Promotion Terms at any time without prior notice, and such amendments will become effective once they are posted on the Platform. Your continued use of the Platform and/or participation in Promotions after any amendments shall constitute acceptance of those amendments.

Only individuals with a valid Membership to the Platform, in compliance with all Terms, are eligible to participate in our Promotions. Participation in promotions requires members to make purchases from our website. Depending on the purchase value, nonrefundable and non-transferable Ticket Vouchers will be issued in the member's name. These vouchers provide an opportunity to win prizes based on the specified value through a luck draw conducted according to our policy.

Ticket numbers are automatically generated by computer systems. You cannot select Ticket numbers as they are assigned only upon checkout and completion of purchase on Pakdeals.

The duration of each Promotion varies, and the date of Prize distribution can occur on any business day at least forty (40) days after the Ticket Voucher is issued. The Lucky Draw date will be periodically published on our website, along with the results announcing the winners of the draw.

Winners of the lucky draw will be notified via email or phone call (details provided to us during Membership registration) on the day of the draw. Unless otherwise stated, each Promotion will have only one (1) winner.

The winner must collect the prize from our designated location, or if unable to do so, request dispatch to their registered address within a sixty (60) day period. Failure to collect or request dispatch within the stipulated time will result in forfeiture of the Prize, and no claims will be entertained thereafter.

If the winner requests courier delivery of the Prize within the specified time frame, we will dispatch it at no charge. Once the Prize is handed over to the courier for international delivery, the risk and responsibility transfer to the winner, and we bear no liability for any damage or loss during transit or upon delivery.

By entering the Promotion, all winners consent to the use of their information, including but not limited to their name, photographs, videos, and call recordings, on our website or associated social media profiles. Withdrawal of consent may affect eligibility for future Promotions.

All Prizes displayed on our Platform will be awarded as shown, with only minor (if any) physical alterations.

We are not responsible for arranging insurance or covering expenses such as travel, medical needs, meals, or any other personal expenses incurred by the winner while collecting the Prize, unless agreed otherwise in writing.
